1. Identification of the Parties

Merchant of Record:
“Paddle.com Market Limited”, Judd House, 18-29 Mora Street, London EC1V 8BT, United Kingdom, processes all commercial transactions and payment-related functions for Starify. By purchasing a paid plan, you also agree to Paddle’s terms and conditions.
2. Purpose
These Terms govern both the use of the Starify service (available at starify.pinc.be and via its mobile-optimized interfaces) and purchases of paid plans. Creating an account or ordering a paid plan confirms acceptance of these Terms.
3. Description of the Service
Starify is a collaboration platform for musicians, bands and choirs. It provides tools to:
- organize songs (structures, sections, tempos, notes);
- capture and store audio clips and reference recordings;
- plan setlists and rehearsal schedules;
- collaborate with other members of a band or choir through role-based access.
Starify offers two freemium tracks — one for individual musicians and one for bands, choirs and other groups — with four plans in total:

Each paid plan includes a one-month free trial. No payment method is required to start the trial. At the end of the trial, the account automatically reverts to the corresponding Free plan unless the user has subscribed to a paid plan in the meantime.
Bands on the Free Band and Pro Band plans are listed in Starify’s public band directory. The Free Band plan publishes basic information about the band; the Pro Band plan publishes detailed information along with a contact option. Details on what is published and how to opt out are described in the Privacy Policy.
Prices are shown inclusive of VAT. Paddle collects and remits VAT based on the customer’s location; the VAT breakdown appears on the Paddle invoice.
The feature set of each plan is described on starify.pinc.be and may evolve over time.
4. Account, Orders and Payment
Use of the Service requires creating an account with a valid email address. Users are responsible for keeping their credentials confidential.
Paid plans are ordered through the Paddle-hosted checkout linked from starify.pinc.be. Payment is due at the time of order. Paddle issues all invoices by email.
Subscriptions to a Pro plan are annual and renew automatically on each anniversary date, unless cancelled by the user before renewal. Cancellation can be made at any time from the account settings or by contacting Paddle through the link in the order confirmation email. On cancellation, access to Pro features is maintained until the end of the paid period, after which the account reverts to the Free plan.
5. Delivery and Availability
Paid features are activated immediately upon successful payment. The Free plan and the one-month trial are activated immediately upon account creation.
Starify is a Software-as-a-Service: access is provided online. Pinc Consulting does not guarantee uninterrupted availability and may schedule maintenance or service updates. Planned interruptions will be announced in advance when reasonably possible.
6. Right of Withdrawal and Refunds
Under European consumer law, consumers have a 14-day right of withdrawal from the date of purchase of a paid plan.
By subscribing to a paid plan, the consumer expressly requests the immediate performance of the service and acknowledges that the right of withdrawal will be lost once the Pro features have been made available, in accordance with Article VI.53, 13° of the Belgian Code of Economic Law and Article 16(m) of Directive 2011/83/EU.
For business customers (legal entities, self-employed professionals acting within their professional activity), no right of withdrawal applies.
Full refund conditions are described in the Refund Policy. Paddle handles refund requests in accordance with that policy.
7. User Content
Users may upload or input content into Starify, including audio clips, reference recordings, song titles, structures, notes, setlists and song lyrics (“User Content”).
Users retain all rights in their User Content. By uploading it, users grant Pinc Consulting a non-exclusive, worldwide, royalty-free licence to host, store, process and display User Content strictly for the purpose of operating the Service on their behalf and on behalf of the members they have invited to collaborate.
Users are solely responsible for the legality of their User Content. Users must ensure that they hold the necessary rights to upload, store and share any material, including copyrighted lyrics, sound recordings or musical compositions owned by third parties.
Notice and takedown. If a rightsholder believes that User Content hosted on Starify infringes their rights, they may send a notice to starify@pinc.be including:
- identification of the protected work;
- identification of the allegedly infringing content (URL or account);
- contact details of the notifier;
- a statement of good faith and accuracy.
Pinc Consulting will review valid notices and may remove or disable access to the reported content and, where appropriate, suspend the account concerned.
8. Acceptable Use
Users agree not to:
- upload content that is illegal, infringing, defamatory or harmful;
- attempt to circumvent technical limitations, access other users’ data without authorisation, or disrupt the Service;
- use the Service to send unsolicited communications;
- resell or sublicense access to the Service without prior written consent.
Pinc Consulting may suspend or terminate accounts that breach these Terms, with or without notice depending on the severity of the breach.
9. Intellectual Property
The Starify platform, its code, design, trademarks and documentation remain the exclusive property of Pinc Consulting SRL. Access to the Service grants no intellectual property rights over the platform itself.
User Content remains the property of the users, subject to the licence granted in Section 7.
10. Liability
To the extent permitted by law, Pinc Consulting’s liability in connection with the Service is capped at the amount paid by the user for the twelve (12) months preceding the event giving rise to the claim. For Free plan users, liability is capped at €100.
Pinc Consulting excludes responsibility for:
- loss of User Content that the user has not backed up independently;
- service interruptions beyond its reasonable control;
- actions or omissions of third parties used by the user;
- decisions taken by users on the basis of information stored in Starify.
Nothing in these Terms limits liability for gross negligence, wilful misconduct, or any liability that cannot be limited under Belgian law.
11. Termination
Users may delete their account at any time from the account settings. On deletion, User Content is removed in accordance with the Privacy Policy.
Pinc Consulting may terminate an account in case of breach of these Terms, non-payment, or discontinuation of the Service. In case of discontinuation of a paid feature, users will be notified by email and any pro-rated refund, if applicable, will be processed by Paddle.
12. Governing Law and Jurisdiction
These Terms are governed by Belgian law. Any dispute arising out of or in connection with these Terms falls within the exclusive jurisdiction of the courts of Brussels, without prejudice to mandatory consumer protection rules of the user’s country of residence.
Paddle’s separate terms also apply to transactions processed through Paddle.
13. Amendments
Pinc Consulting may update these Terms at any time. The version in force is the one published on starify.pinc.be on the date of use. Substantial changes will be notified by email or through a visible notice on the Service.
